What Businesses Need To Do

As of March 8, 2011, smoking will be prohibited in outdoor dining areas in the City of Los Angeles.

Compliance is Easy!

For restaurants, cafes and food courts

If you operate a restaurant, cafe, food court or business defined in Section 41.50 A.7.a or 41.50 A.7.b of the Los Angeles Municipal Code, you are required to:

• Request that patrons not smoke within 10 feet of outdoor dining areas.
• Post permanent signs that use the “NO SMOKING” phrase or international no-smoking symbol, followed by the words: “in this outdoor dining area or within ten feet of it.”
• Permanent signs must be clearly visible and readable to most diners in the outdoor area and most persons passing outdoors within 10 feet of it.

Non-compliance can result in up to $500 in fines.

For food kiosks, food carts and mobile food trucks

If you operate a food kiosk, food cart, mobile food truck or business as defined in Section 41.50 A.7.c of the Los Angeles Municipal Code, you are required to:

• Request that patrons not smoke within 40 feet of food kiosks, food carts and mobile food trucks.
• Post permanent signs that use the “NO SMOKING” phrase or international no-smoking symbol, followed by the words: “within forty feet of this business.”
• Permanent signs must be located near the cashier and clearly visible and readable to a majority of customers.

Non-compliance can result in up to $500 in fines.

Exceptions

Bars, 18 and older nightclubs and restaurants, businesses or non-commercial buildings that are completely closed to the public for a private event are exempt from the ban.
